Yes another Starcrap thread (legal)

Post by DCL »

And for everyone who is sick of Starfoce talk just skip reading this thread! Simple. :) I know there's a dirge of threads about SF but I was really curious about this question. Apologies to anyone who is sick of SF threads and all...

I was just reading a thread over at ubi's SH3 MB and they were talking about the legality of Starforce being installed on your computer without your permission.

Anyway some of my questions. Is Starforce legal the way it is installed on computers currently? Is it legal the way it seems to mess around with other purchased software on your system? Do the people who have had their computers fouled up because of Starfoce, do they have any legal options at all? I mean Starforce is not exactly mentioned in the EULA. Heck do the people who don't have a problem but don't like the fact that it was installed w/o your permission, do they have any legal options. ;)

I mean does this exchange over at ubi's site have any legal basis at all?

Not to add fuel to this fire! But the EULA (which I actually read for the first time ever) doesn't include any information about copyright protection.

However, on the back of the box and DVD case it says: "This game contains technology intended to prevent copying that may conflict with some CD-RW, DVD-RW, and virtual drives."

So technically, just by opening the box you're agreeing to the conditions of the protection. It's not a big deal to wait 10 seconds for it to check the DVD. And am I the first to mention that anyone who paid 50 Euro's, you've paid more than anybody else. Considering I only paid around $60 CAD.

all games have that on the back of the box..by opening..you are not agreeing to any software intrusions like StarForce....

just about every Copy Protection built into games..is kept onto the DVD or CD-Rom...

Starforce installs itself WITHOUT your consent by not being put in the EULA or by a window popping up during the installation of the game..which then you have to agree to by pushing next...

By not informing you that it is installing itself to your computer is in the US ILLEGAL!!!!!!!......Plain and Simple
I doubt myself that there's any chance for legal action but I was just wondering about any opinions from people who know more about the law, ELUAs, (and how it pertains to computers nowadays) then I do about the legality of it all.

Thanks.

The new spyware legislation may have something to say on this. A lot of spyware gets installed as a result of some small line like that in the EULA, which no one reads.
