It is legal to provide free alcoholic beverages without a permit. However, to be truly "free," it must be available to any adult who walks in the door and requests it. If alcoholic beverages are only available to paying customers, the assumption is that the cost of the alcohol is included in the price of the service. This constitutes a sale of alcoholic beverages, and a TABC permit would be required. When you provide the alcoholic beverage, there cannot be any expectation of receiving money. You cannot ask for a "donation" or "tip." If the drinks will only be available to paying guests, then you will need a permit.

Some examples: A wedding reception with free drinks is really free. A boutique that serves free wine while you shop, even if you don't buy anything, is really free. A nail salon with a "free" drink when you pay for a manicure is not really free. If you buy tickets to attend a charity ball and they serve "free" drinks, those are not really free. If a tip jar sits next to a keg of beer expecting "donations," the beer would not be considered free.

It's a private party. The cost is 100% to cover the evening. They lose money every year. And have paid the state a considerable amount of money to use their parking for as long as I have been going. I figured we were in trouble the moment Granholm refused us parking this year. And I didn't think it would be because of the liquor license. I figured it would be because they'd get building inspectors in and have them throw a fit for all the permits that weren't pulled to build structures. I am assuming that is the case now but I don't know. I'm not on the inside. The shittiest thing the city did was to wait until yesterday to say there was a going to be a problem. They've known about the party in general for years and they've known about this years party for months.

The real problem is that TB got too big. Growing is fun. But there hits a point where it's too big to be friends doing great things for the scene and at that point bureaucracy and the fun police take over. Facebook talk (which was probably the series of nails in the coffin) is about how this will make them prepared for next year. The reality is that I'd lay 20 to 1 that Ken will be done with it this year as I am sure the stress and hassle went way past his love for the arts. John has to be crushed.

Our own little piece of Burning Man like love for Halloween is likely to die this year.

I agree with you there LM, this has been a halloween staple around here and to pull the plug so close to the event is pretty crappy.
My remark about the liquor license was more about personal experience. When I lived on the other side of the State we had a blues festival on the sunday before labor day. We tried the ticket gets you beer thing but got stomped on for it like a narc at a bike rally. We did eventually get permits so it was all good in the end. On the plus side I got to jam with Lil Ed and the Blues Imperials in a private bar party ( I was DJing at the time ) after the festival. One of the best nites of my life.

Just got back from seeing The Wall. Unbelievable show. If theres anybody out there, who appreciates an amazing production, then get tickets at your nearest venue immediately. It was the best stage prodution I have ever seen, the music was tight and virtually flawless. Rogers voice was strong the entire show. I had lower bowl seats that were in the first row and center stage. For this show those seats were perfect as a full view of the complete stage makes a big difference. I could rave all night about it. If your on the bubble about seeing this do yourself a favor and do so. I guarantee you wont regret it.

I've had The Winter of Mixed Drinks playing since Saturday and the damned thing just keeps sounding better and better after every listen. It feels like The Joshua Tree Part II: The East Coast. Like U2 right at the pinnacle of their career. That same sort of reflection on life through story telling inspired by withdraw into nature. And the music has the same honest passion to it as well.

I'm psyched for tonight. If they are disappointment, I'll blame you.

Really, I'll blame the Magic Stick. While they are the best magnet for (inter)national acts I want to see the house sound is horrible for anything but a punk show where the sound is often only as important as the energy it generates.

I just found out that Nitzer Ebb is gonna play a show in Houston the day after Thanksgiving. I really wanna go, I've always loved them and they put on a great show. I'm psyched they have new music out now.

Thought about the Genitorturers but I'm already too busy and I'll be at Teasetown in Ypsi on Friday instead.

You should have made it out to Mad Sin at Small's last Thursday. They ended up being anticlimactic but only because The Dreadnoughts were at least in the top 2 of live shows this year.

The list of exceptional shows probably goes in order of something like:

Futureheads
Dreadnoughts
Black Jake and the Carnies
Juliette Lewis
Lords of Acid
The Eels
Girl in a Coma (the first time, they were actually pretty lame the second time. I have no idea how that happens)

Mister Ed is on for next week and I'm debating Reverend Payton and also Creepshow. Likely it will only be Nitzer Ebb though. I just don't have the time, energy, or money.

How sad that neither Gogol Bordello nor Flogging Molly, traditionally my two favorite live bands made the list (and I saw both). Neither band is scaling up to larger crowds well, IMO.

tip from a veteran. dont wear any clothing that you wish to keep. and buy a white tee shirt from the merch booth, or bring your own. write GWAR on the front in marker, and you will fit in.

quick report from the GWAR show....Oh My!

first off, the show was in an awesome venue....The Gothic Theatre in Denver. i only paid $22 for the show and i was shocked when i walked inside. the venue is an old theatre renovated for concerts. all tickets are general admission. i walked in and walked right to the front where i could reach out and touch the stage. not sure how many people they can cram in there, but it can't be much more than a thousand. it has a small floor section with a bar and the balcony where the less than ambitious concert goers can sit. regardless, there is no bad seat. even at the very back you are probably 75 yards from the stage.

the first band was so-so and the second was a death metal band i really didn't care much for.

however, the third band was The Casualties! until the show i had heard rumors that this band was really good and a throwback Punk band. WOW! i had moved out from the front of the stage and up to the balcony after the 2nd band because the drunk idiots had started to make trouble and boy was i glad. the pit during The Casualties was the craziest i had ever seen at any show. but these guys were phenominal and super performers. i would pay good money to just see them again. their cover of Blitzkreig Bop was freaking awesome. i encourage anyone who likes punk to look for this band....damn great show.

and then came the Scumdogs of the Universe.....GWAR! i knew we were in for something ridiculous when they took about an hour before GWAR came on to put trash bags over anything valuable inside the venue. what happened after that was incredible. best live show i've seen by far. what i find interested about GWAR is that not only is the theatrics awesome, but i think they are great musicians. i really really like their music alot, even if i never knew about the stage show they put on. i intentionally wore older clothes with the intent on getting soak....and soaked indeed. they killed several zombies, a dog, Sarah Palin (my favorite part), and Lady Gaga.

my only complaint is that there were about 500 too many teenagers there causing trouble and acting like punks the entire show. if they had made it a 21+ show, i would have stayed by the stage and had a good time. it was 16+ and 99% of the trouble was with the drunk teenagers.

regardless, unbelievable show that i'll go to again whenever GWAR comes around. even if you don't know their music, you gotta go for the experience. i already told the wife she is going next time whether she likes it or not

I'm inclined to do the Pogues mainly because I've never seen them before but I've heard so many stories of Shane MacGowan getting on stage, doing three songs pissing himself drunk, basically fighting with his band mates, puking his guts out and stopping the show. I am so not paying $45 plus service charges plus $8 beers to even have that be an outside chance of happening.

at the show i went to this year, James, Spider, Jem, Phil and the rest of the musicians did not disappoint. Shane was out of tune/time all the way through and seemed kinda like an unnecessary weight on the rest of the band, however. i'd still see them over any of the more current knock-off bands any day.

This was my experience when the Pogues played Portland. The band was tight but Shane was literally staggering around the stage and unable to sing fast enough to keep up with the music. It was more sad than entertaining.

Cake just announced they are finally coming back to Detroit on May 18th. Does that constitute a summer show?

Actually it shouldn't be too much longer until more and more bands start announcing their plans for the beginning of next year and March always seems to be a strong beginning to concert season. So I'm awaitin'.

I'm a little concerned that all of my "cheap" shows seem to be going up in price by a fair amount. Part of it is bands I like seem to be getting bigger. (good for them) Part of it is concert goers seems to be returning from pop/large venues/bands back to "alternative" small venues/bands again like they did in the early 90s. And part of it is just inflation. But I'm not sure I can adapt. I'm used to doing a lot of $10 shows with $3 beers. It's a totally different ballgame for $35-$45 shows (which seems to be the top end for "small" venue shows... I hope) with $5 - $9 beers and parking and ticket service charges. $10 shows that make for $40 evenings are a lifestyle. $35 shows that make for $100 evenings (for one. $200 evenings for two) are special events.

I don't need my every show to be a night to remember. But I do expect $200 evenings out to be nights to remember and they often aren't, so 2011 may be a show seeing game changer or I may have to find a way to find even "smaller" bands while still feeling like I've a good shot at seeing some good talent for a night out.

My summer shows for December look like:

12/18 - Santarchy Detroit. I'll probably catch 2 or 3 local bands I've never heard during the pub crawl next weekend.

And right now I've got nothing January or February. That's just crazy. It's time to go looking for new other labels for interesting sounds. Lately I've combing through some of Stomp records stuff.

Saturday night was the Roger Waters "The Wall" show.

Amazing, amazing show. One of those "bucket list" shows for me.

Good thing it was good since it took an hour and a half to find a place to park. We finally found a spot at 7:45 (show was to start "promptly at 8"). Made it in with about 10 minutes to spare thanks to a late start.

When we got back to my brother's car we found it locked, running, with the keys in the ignition.

I saw the Pogues at House of Blues within the last two years (need to go check my stubs) and enjoyed the show. It was clear that Shane was getting drunker throughout the evening, but it certainly didn't detract from the show. Spider wound up with someone's black cowboy hat.

While I was leaving, I wanted to get away from the crowds and managed to take a wrong turn. I wound up in the backstage hallway when I see Spider coming the other way. He ducks into what I found was the green roopm before I got close to him, but saw the whole band in there as I walked by. I finally found an exit door and wound up walking out the band entrance through the metal barriers they had set up right outside the bus.

Anyhoo, Flogging Molly will be playing HoB here on Feb 8th and Cake will be here on Dec 30th. Cake is higher than FM, and the timing make it unlikely I'll make that one, but I'm giving FM a serious thought as a run-up to the North Texas Irish Festival in March.

After taxes/fees, two tickets to FM are just over $100 ordered. If things go well, this will be a date night with the girl I went out with on Monday. If things don't go well, ... it really doesn't bear thinking about.

Cool and ouch all at the same time. I wouldn't even have bought pogues tickets at the price they were asking but they were gifted to me.

I thought January was going to be a completely empty month. But now on the 14th I'll be seeing Laurie Anderson with redrun and the 15th will either see a local band, the Slammin Zeros (who has Loomis in it from the Gone Gold days, BTW) or will head out to see the Detroit Fire Guild which will have several local bands and I might make it out to the Detroit Derby Girls on the 29th... Add in a local science fiction convention on the weekend of the 21st and suddenly January is booked.

I need more vacation time.

Crazy how time fills up. On December 31st I was free until March. Today January is booked and so is half of February.

BTW anyone here ever see the Dum Dum Girls? They're on my might see list, but suddenly they're pretty far down the list as things are looking too full.

Oh, and ZCorn, I'm not up for Motorhed again so soon but they are going to be at the ROMT with Clutch in February.

Yeah, Motorhead is playing here in GR also. It may be sacrilegious, but I am just not a fan. I think Lemmy is kick-ass as a human being but I've never thought their music was very special. I'd go to see Clutch though, they are still awesome...

I've already got tickets for Cake on the 13th. I"m seriously considering going to see the Decemberists at the Schnitz and I just found out Corin Tucker is playing the Doug Fir on the 25th.

I'm excited about seeing Cake again - it's been years. For awhile they were coming to Portland at least once a year.
