Susan Collins said today that she'll vote to confirm Jackson. I haven't heard anything about Sinema, but I very strongly doubt that Collins would do this if she had much doubt about Sinema's vote (and as much as I dislike and distrust Sinema, the odds of her tanking Jackson were always pretty low).

So unless something dramatically changes I think this all but ensures Jackson's confirmation.

I'm still sticking with my guess of 52 yes votes FWIW, though more is possible.

As expected, Lindsey Graham is a no.
I oppose and will vote against the nomination of Judge Jackson to the Supreme Court. My decision is based upon her record of judicial activism, flawed sentencing methodology regarding child pornography cases, and a belief that Judge Jackson will not be deterred by the plain meaning of the law when it comes to liberal causes. I find Judge Jackson to be a person of exceptionally good character, respected by her peers, and someone who has worked hard to achieve her current position. However, her record is overwhelming in its lack of a steady judicial philosophy and a tendency to achieve outcomes in spite of what the law requires or common sense would dictate. After a thorough review of Judge Jackson's record and information gained at the hearing from an evasive witness, I now know why Judge Jackson was the favorite of the Radical Left.

EDIT: Oh, and making D.C. and Puerto Rico official states to get more representatives in Congress. We should be fighting like hell right now because you can be sure when the GOP attempts to take over in 2024 they're going to do everything they can to make sure they never lose power again.

This is the scary part. I thought it was all just chicken little warnings earlier, but after watching them make heroes out of people like Viktor Orban and Putin (while it was still acceptable for them to do so), I really do believe they'll try to shape democracy in such a way that it becomes an autocracy under their watch.

Well while it was expected I wasn't 100% sure they would get the confirmation through. Now if we need to fill another spot before 2024 it will get SUPER ugly. Well lets be honest it will be impossible after the midterms. :P

well to be fair even if it was a white dude it probably would have been the same thing. Everything is about party over country to the extreme now.

This is happening right now. The big news is someone leaked a draft of the opinion on *the complete overturn* of Roe in advance - most likely penned by Alito. Just to be clear someone felt it was important to *leak an internal draft opinion in advance*. As far as I know nothing like this has ever happened. In any case the language is stark. We are watching a SCOTUS that doesn't care about legitimacy. It'll be interesting if the language in the politico piece survives because it is inflammatory and reactionary.


The Supreme Court has voted to strike down the landmark Roe v. Wade decision, according to an initial draft majority opinion written by Justice Samuel Alito circulated inside the court and obtained by POLITICO.

The draft opinion is a full-throated, unflinching repudiation of the 1973 decision which guaranteed federal constitutional protections of abortion rights and a subsequent 1992 decision – Planned Parenthood v. Casey – that largely maintained the right. “Roe was egregiously wrong from the start,” Alito writes.

“We hold that Roe and Casey must be overruled,” he writes in the document, labeled as the “Opinion of the Court.” “It is time to heed the Constitution and return the issue of abortion to the people’s elected representatives.”

It is hard to overstate how out of control things might get with this court in the next few years Also important to note this is just what we believe to be a draft of Alito's majority opinion. We don't know who voted for it and it doesn't have any of the probable dissents.

More and more I'm convinced the United States won't survive as a union much longer. I think this is a huge step toward that eventual dissolution.

Maybe. If the Supreme Court keeps signaling it is going to roll back law to before the Civil Rights era we may very well see violence. That violence may tear us apart or it may usher in the authoritarian age. Hard to know at this point.

If I were a betting man, I would have put the odds of a dissolution at around 35-40% in my lifetime, and around 55-60% in my kid’s lifetimes.

If/when the GOP catches this car and starts on the others they’ve been so actively chasing, I’d raise each of those percentages by 15 points, at least.

I just don’t see how the country survives the continual stripping away of fundamental civil rights without fracturing.

It's pretty obvious that our political and constitutional system is fundamentally broken in a way that won't be easy to fix, since a lot of it is rooted in an archaic constitutional structure that can't be easily changed. I think that the odds that we pass through a period of authoritarian rule are fairly high (probably better than even). I don't think secession and the end of the union are a realistic danger, though if authoritarianism takes firm root here a lot of unthinkable things will become more plausible.

The one upshot here is that I don't think this is the best outcome for the right / the GOP. The reality is that the state of abortion rights has become so grim that the right already had probably 95% of what it wants on abortion, without the political upheaval that will likely result from an outright overturning of Roe.

Abortion would immediately become illegal in at least 13 states if the Supreme Court were to overturn Roe v. Wade:

Arkansas, Idaho, Kentucky, Louisiana, Mississippi, Missouri, North Dakota, Oklahoma, South Dakota, Tennessee, Texas, Utah, and Wyoming.
I just don't even have the words anymore.

Also honestly, every time shit like this happens I recurse the name of Ginsburg, who in her arrogance decided that she couldn't be replaced, and whose decision directly led to Barrett now being on the court. It's not totally fair that she was in that position, but she was, and she didn't listen to the allies who warned her.

I would at this point also prefer to see the union dissolved or a constitutional convention that'll revert to some regional model or whatever will keep the peace. That won't happen, elections will still result in little change while the word advances, and we will may very well see the first generational living standards decline. I don't know what it'll look like exactly but none of this is trending towards stable or anything representing democratic values.

After completing the reading of the draft I find myself a little shocked. Not necessarily about them overturning Roe. I sort of expected that but also thought maybe they'd try to preserve their legitimacy by taking a technical road. However, where I'm sort of very concerned is that they took a hardline position on implied rights. That's scary. A lot of our jurisprudence is built in layers of a hundred years or more of implied rights and interlocking case law. All of those are now fair game? Subject to the whims of these juristocrats? Our age of authoritarianism might already be here.

This is why Mitch McConnell accepted Trump, to the detriment of the Union. Judicial activism of this extent will unleash the fury of liberals and shock moderates. The Face-Eating Leopards are finally eating us in the open, after openly planning to do it.

The backlash may be enough to get the votes to reform the Supreme Court.
