Breaking: The D.C. Court of Appeals has just said the House Ways and Means Committee can obtain Trump's tax returns from the IRS.
It is why I don't have much hope the system self-corrects. The courts are vulnerable to powerful bad actors who don't care about the system surviving.

ATLANTA (AP) — A judge said Tuesday that Rudy Giuliani must appear in Atlanta in person to testify before a special grand jury that’s investigating whether former President Donald Trump and others illegally tried to influence the 2020 election in Georgia and set his appearance for next week.

Giuliani’s lawyers have argued that a recent medical procedure to place two heart stents has left him unable to travel by plane.

FWIW this bolsters the idea that at least one component of the search was that they were trying to get records back. He had given back 15 boxes of material and they weren't getting cooperation getting back furth material they *knew* they had seen with their own eyes. It seems reasonable to expect they were able to convince a judge the records existed and due to the volume it was worth getting them back since they weren't being stored at a secure facility.

Edit: I still don't believe they'll charge Trump with anything. Garland simply doesn't have the stones. This story also nicely lines up with the idea that they are protecting the institutions. If true it's possible this story is leaking because they wanted to get the story out there to attempt to depoliticize this without breaking their own rules about commenting on an investigation.

I almost went on a rant in the Deathwatch thread about this. I'd say in this case the NY Times coverage was more of an outlier. As far as I could see the other big players played it straight. NY Times played up the politicization angle in an irresponsible way IMO. Something has gone very wrong with that newsroom.

Ugh. Didn't see that yesterday. Most of the coverage yesterday early was fairly straight.
The partisan outcry was the opposite of what Garland, a former federal judge, has sought in his 17 months on the job.
Huh. Imagine that. It is almost like the outcry is intentionally premised on the media AMPLIFYING it. I don't know how we dig ourselves out of this tribal warfare when we have these irresponsible flacks pouring gasoline all over it. At least this was in the OpEd section where the NY Times put it above the fold but jeez what a shit take. Nope looked it up wrong on the site. It *SHOULD BE* opinion but it's reported. Absolute garbage.

Edit: This issue gets me pretty hot under the collar. A big reason we don't have rule of law is precisely THIS type of behavior. How are we supposed to enforce the law on the powerful if the media is going to frame it as political every time? Garland has bent over backwards avoiding looking political to the exclusion of reason but that doesn't matter. Once he crosses the invisible line that divides how the law treats the rabble from way they treat the powerful the gloves come off. It makes rule of law impossible to achieve and it isn't too hard to cynically draw a line that they themselves want that blanket of elite impunity.

They've now changed the headline and completely buried the piece. It was "Garland vowed to depoliticize Justice. Then the FBI searched Mar-a-Lago"

They updated the headline.

I think they are trying to soften it a bit. The story is out there in the print edition but not on the front page. It's in the A section. Yet, it isn't on WaPo's front page online. It's buried in the National Security section. Other stories that didn't make the print edition are featured on the front page of the web site right now instead. I also note that it is pretty much the only story concerning recent Trump events with comments turned off. I went in ready to give them a piece of my mind. ;)

BREAKING: Trump pleads Fifth, refuses to answer NY AG questions about Trump Organization’s alleged tax and financial fraud. This is a civil case — so the court can draw an inference of liability. This is exactly what the AG was hoping to achieve. The case is now even stronger.

Also, did I miss the memo where sitting senators are now floating nonsense about the nature of the search? How is this being tolerated? I mean, we all know Rand Paul is a giant bell-end, but seriously? This is acceptable?


Rand Paul suggests the FBI may have planted evidence in boxes they seized from Mar-a-Lago
