Intent is no longer important when it comes to treating unclassified documents. In the indictment he and the aides were LAUGHING after mentioning "these documents are marked CONFIDENTIAL", and DOJ have this on tape.

It is clear Trump had always intended to keep as many of the classified documents as possible, including instructing his attorneys to lie for him (knowingly or not). Intent no longer matters. He knows it's wrong to show it around, he did so intentionally, even saying on tape "as president I could have declassified it, now I can't, you know but this is still a secret."

All that "I could have classified it in my head" was just bogus excuses dreamed up by Rudy, and look at what happened to EVERYONE of Trump's attorneys since. It's only good for MAGA propaganda and would never stand up in court.

The really sad part is GOP is still going on about "he may be a bastard, but he's our bastard", because GOP is still controlled by MAGA faction, and DeSantis is still living in his dreamland (aka Florida) and none of the other candidates is likely to draw big votes, despite all the vote rigging attempted last election and since.

True, but I've never seen an individual so fixated on a "type" before. I'm sure he would surround himself with clones of his daughter if he could get away with it. Interesting fall out from the Trump tape is now folks are wondering why the government never searched Bedminster considering there are filings indicating they knew that Trump was moving documents back and forth. The main line is that they believed the bulk of materials were at MAL but still...he had some serious materials and it seems potentially reckless to ignore the risk that he indeed very well could be hording some in NJ.

Thank goodness they fixed health care in the first 100 days of 2016 with that super secret plan he had that the GOP bantered around as the great solution to Obamacare. No idea where we'd be now.

(In truth, I'm so glad they didn't gut the ACA, I'll looking at how to get on it in October, while I'm paying nearly $700 a month for COBRA right now, which is about 1/3 of my total monthly spend)

Good riddance. There are a lot of lawyers I could point to that probably shouldn’t have a license to practice law, but Giuliani is at the top of the list (or maybe he shares that top spot with Eastman and The Kraken).

Several developments on the Trump trial front - we'll get our clearest indicators of how this might go soon.

NY Times
Lawyers for former President Donald J. Trump asked a federal judge on Monday night to indefinitely postpone his trial on charges of illegally retaining classified documents after he left office, saying that the proceeding should not begin until all “substantive motions” in the case had been presented and decided.

The written filing — submitted 30 minutes before its deadline of midnight on Tuesday — presents a significant early test for Judge Aileen M. Cannon, the Trump-appointed jurist who is overseeing the case. If granted, it could have the effect of pushing Mr. Trump’s trial into the final stages of the presidential campaign in which he is now the Republican front-runner or even past the 2024 election.

While timing is important in any criminal matter, it could be hugely consequential in Mr. Trump’s case, in which he stands accused of illegally holding on to 31 classified documents after leaving the White House and obstructing the government’s repeated efforts to reclaim them.

There could be complications of a sort never before presented to a court if Mr. Trump is a candidate in the last legs of a presidential campaign and a federal criminal defendant on trial at the same time. If the trial is pushed back until after the election and Mr. Trump wins, he could try to pardon himself after taking office or have his attorney general dismiss the matter entirely.

A 2 day delay is not bad given the nature of this case. I would stop freaking out over his request to move it to after the election until that motion is ruled on. It seems pretty obvious he is just trying to run out the clock and get past the election as the only real basis of his motion so hopefully Cannon grows a spine and acts like a Judge instead of a Maga Stooge.

Right - a two-day delay is not concerning. I think the true test is how she rules on motions they agree on and those they do not agree on. The 2-day motion is the former. The other longer delay they requested and the "competing" DOJ request for a delay to around the Nov/Dec time frame are the latter.

2 day of course.is not what I'm worried about. That's perfectly normal. I will not be surprised if she allows his motion to dealy until after the election. She already showed that she's just a stooge, but hey it could end up being fine.

Several Miami lawyers, some of whom asked to remain anonymous because they have active cases before Cannon, noted that Trump’s chances to win what otherwise appears to be an insurmountable criminal case increase the further north he goes.

“You drive around, and you’ll see ‘Trump’ flags and ‘Make America Great Again’ flying in front of houses,” said Paul Bernard, a criminal defense lawyer in Fort Pierce. “With Trump’s trial down this way, he’s going to have a bunch of supporters—and they’re going to make their way onto the jury panel.”

According to local court rules, federal trials in the Fort Pierce division draw jurors from five counties: Highlands, Indian River, Martin, Okeechobee, and St. Lucie.

It’s solidly MAGA country: all five counties voted heavily in favor of Trump in the 2020 election he ultimately lost, with Okeechobee topping out at 72 percent. Across the board, the former president nabbed 62 percent of the vote on average.
I'm assuming this was all accounted for in a worst-case scenario by the prosecution and that there are things happening behind the scenes that I just cannot appreciate, right?

Well, there are no easy answers here, and we shouldn't count on the criminal justice system to save us from Trump. The big question / decision point was around where to file the documents case. I get the general sense that filing it where they did is at least defensible. Beyond that they'll do what they can in jury selection.

This is the pessimistic take (and may well be what happens).

On the other hand, we, but more importantly the DoJ, will know if she is going to try to throw the trial right now based on her ruling here, and could be likely to start the appeal process to reassign/move the case to a different judge - which would IMHO, be very bad for her future as a Judge...

I mentioned it before, but I live in the town south of Ft Pierce where the trial will take place.

That news story is accurate, Trump flags are everywhere around here. St Lucie is a blue county, but it’s getting redder every election. And the counties south and north of us are deep red.

How would it be bad for her? One reason this might happen is because she is untouchable.
