You know, I half suspect that someone, possibly Bannon before the falling out, told drumpf that he is completely free to follow in the nazis footsteps, because any time someone calls him out for doing nazi-like things, there is immediate backlash. Godwin is your best friend, mr. drumpf. It's like a pre-existing cultural defense when anyone calls someone a nazi. Create brownshirted "private" citizens to keep the peace and then someone calls them "brownshirts" and there you go. 3/4 of the country will say the person is crazy and dismiss them out of ahnd because there can only be 1 hitler, ever.

If you read what he wrote a little closer, you'll see that he's calling all of us brownshirts, not that we're going to make accusations about other people being brownshirts. Because you know, dogpiling onto an unpopular viewpoint is absolutely how the nazis got started.

In a victory for the cable network and for press access generally, Judge Timothy J. Kelly granted CNN’s motion for a temporary restraining order that will prevent the administration from keeping Acosta off White House grounds.

How soon until drumpf calls into question the impartiality of the judge?

More so, I mean.

edit: Omfg, he's a drumpf appointee? This just keeps getting better and better. Normally I assume due diligence when making appointments, so I don't even pay attention to who made the appointment. Since drumpf is constantly undermining anyone who didn't come into power under his guidance, this is too sweet.

edit: Separately, this is also good for the protection of Free Speech and free press. I guess that's important too. :wink:

Honestly, I don't think any of the sub-SCOTUS nominees in the administration were scrubbed for loyalty to Trump. My understanding is that they were all scrubbed by the Federalist Society and people aligned with it, so were scrubbed mainly for loyalty to conservative beliefs. And this doesn't really concern core conservative movement beliefs (low taxes and regulations). Plus you have Fox News aligned with the plaintiffs. So (without knowing the relevant legal principles here well) this doesn't seem shocking to me.

My impression is that the judge ruled on the basis of the lack of due process (the 5th amendment angle) rather than anything to do with free speech per se.

I don't know if it was part of his ruling, but I read that his comments included a statement there is no 1A right for reporters to be permitted to the WH, but once the WH admits them, it has to do so in accordance with 1A principles (in other words, there has to be an objective test for exclusion). Since there's no apparent test administered here, that's why 5A due process rights are involved. That seems about right to me.

He also cast aspersions on the WH's changing reasons for revoking the credentials (first because he assaulted the intern, then because he was hogging the mic), and he also commented on the dubious nature of the video the WH used to support the initial assault allegation.

2) Will you publish only positive information and facts with regard me? Positive being defined by me on a case by case basis.

Failure to meet both criteria is a failure of the test.

Shrug. I'm confident that drumpf doesn't understand anything but that he's not allowed to kick Acosta out. Even with the "yet" involved, I'll happily imagine him sputtering ineffectually.

I'll just point out that having a stay is still a free speech win, as there have been plenty of times where a judge has let the restriction stand while everything gets sorted out. It's not the war, but it's the first battle, and the free speech side won.

Technically this is a grant of a request for a temporary injunction, and so not a final ruling, right? Though it seems unlikely that the judge will feel differently at a final ruling stage, I imagine.

That's what these guys are saying. I haven't read the details myself, only what's been posted here.

It's certainly possible that he'll rule in favour of CNN while providing the WH with a road map on how to do it legally *next time*, at which point Acosta will be lured into a trap presumably. Of course it will be a trap set by 5 year olds, so he can probably handle it.

Or they'll just make more effective lies.

Yes to everything. This is pretty much what I thought would happen when the news of the suit first happened, and I can't imagine a final ruling would be different based on the facts here. If the WH were smart (hah!), they would just give Acosta back his credentials and never call on him. (FWIW, although CNN is owned by AT&T, I'm in no way involved with this particular litigation.)

You'd think that's how it would have played out in the first place and if they were ever called on it be up front. Acosta won't give up the mic once it's in his hands. These meetings a brief and I'm not going to play his game.

Trump would never be able to crow about 'winning' if he simply took a passive action like not calling on Acosta. Trump has to let everyone see the winning overtly.

If that happened, I would expect, eventually, that every member of the WH press corps would just hand the mic to Acosta when drumpf called on anyone. I think they're pretty unified and they know it's a "first they came for the Acosta, and I did not speak out" situation.

I'd like to believe that, and given how the corps banded together when Obama's WH and Fox News got into it several times.
A Treasury Department spokesman described the dispute as a miscommunication – “much ado about absolutely nothing” – that ended with Fox News interviewing Feinberg on camera for the Oct. 22, 2009, nightly news. Fox News reported that the administration “failed in its attempt to exclude Fox News” only after “the Washington bureau chiefs of the five TV networks consulted and decided that none of their reporters would interview Feinberg unless Fox News was included.”
Fox did a bunch of things to reduce Obama's reach to Fox's audience, including not bothering to broadcast his healthcare address to congress. The WH did a few things in retaliation, most of which were peanuts comparatively. Still Obama's administration took several steps to reduce Fox's access.

So yeah, lots of back and forth there.

The Justice Dept. went after a Fox journalist as "co-conspirator" regarding leaks, and many news organizations protested through editorials etc. Several government employees and contractors were charged, but I think the journalist had nothing happen. The Justice Dept. revised its standards on subpeonaing reporters.

My point was mostly that the media (even the MSM, omgwtfbbq?!) defended Fox when they got into it with Obama and Co. I would like to think Fox would do the same in return, and they said they were going to file an amicus brief in support of the CNN lawsuit, so that's something.

Right. It's not like journalists are allotted regular turns. Trump calls on Acosta intentionally so that he can belittle CNN, generating MAGA cred with his base.

Acosta and Trump are playing different games: journalism vs demagoguery.

An update on the current state of affairs:
“We’re talking about border wall, we’re talking about quite a big sum of money, about $5 billion,” the president told reporters Saturday before leaving the White House for a trip to California.

“This would be a very good time to do a shutdown.
Threatening shutdowns in a Republican controlled Congress? But this one is my favorite:
I don’t think it’s going to be necessary, because I think the Democrats will come to their senses, and if they don’t come to their senses, we will continue to win elections,” he added.
