There was no finding by the court with respect to what was true - outside of the denial of Manning's motion to dismiss. The case was settled before then.

We have one side of the story - that is crafted in such a way as to exert the maximum pressure possible to force a settlement. There are other people that have additional information. Those people have all discarded this story as nonsense. Of course, these same people also discarded all of the Deflategate stuff as nonsense as well, so what do they know? :)
As I recall, the sworn testimony (from a deposition?) of one of his teammates (with no dog in the fight, as I recall) directly contradicts what Manning has said (aand written) happened. As such,the second defamation settlement (re the book) is far more damning to me.

PS the Jets willingness to take him is not evidence at all. AS I said, the incident is not as big a deal as the coverup/ongoing allegation about her character and all of that happened after the draft (and still wouldn't be enough reason not to draft him, IMHO).

The incident was an immature teenage dick move (and not apparently part of a pattern/problem for him), the ongoing allegations about her in the book are a grown up business dick move, and he's paid for that in his settlement. To me, it's done - I don't really care that much about it from that perspective. But for an ongoing problem at Tennessee, that IS a big deal to me.

The thing is, we don't have one side of the story - we also have Manning's from the book. But yeah, I don't really care that much about it to keep writing about it.

Thanks to PFT, we also have some more details.

It should be noted that the tone of the PFT article is due largely to the irritation that Mike Florio has for the way that Shaun King has reported on this - and how he grossly misunderstood what document it was that he was originally given.

In short, when the trainer brought the defamation suit against Manning, his lawyers filed a 52-page motion for summary judgement. The 74-page document published by the Daily News was her lawyer's rebuttal to that motion. Manning's lawyers also filed a subsequent rebuttal to that, which basically amount to - "I mean seriously, look at this crazy shit".

Regardless of what a person's ultimately conclusion is about what happened back in 1996, I think it's reasonable to say that your opinion should be formed by reading all of the documentation and understanding the context of each. Simply reading her lawyers 74-page response and treating it like the Book of Genesis handed down by God (as the Daily News writer did) undermines you in my eyes.

Absolutely. My favorite part was how Shaun King made a big deal of the lawyers' response being called (as is standard, incidentally) a "Statement of Facts."

It's a motion for summary judgment, for crying out loud. The statement of undisputed facts is required . . . And so is a response to the statement of undisputed facts, in which it is regularly revealed that said facts are not, in fact, undisputed!

To take what's in the statement as "fact" fails Law 101.

I downloaded and listened to Florio's hour long podcast on the topic, just to have him explain the legal side of things (he was a practicing lawyer for almost 20 years so is more familiar with the process than I am). The thing he seemed most perplexed about was the fact that the other UT player that was in the locker room for the 1996 incident was never questioned under oath by anyone, especially not by Manning's lawyers.

He signed an affidavit, which was used to grill Manning during his deposition. The notion that they never deposed Saxton under oath is perplexing (to him).

It’s been over two weeks since Shaun King wrote the Peyton Manning story that changed the sports landscape forever. Since then, we have found out a lot about him and his subject, Jamie Naughright.

What Ms. Naughright might have underestimated about the news sphere in 2016 is that extreme transparency works both ways and for her, that is proving to be a very bad thing.

Jamie Naughright appears to be obsessed with sex and sexuality. The list of people that she has attacked with sexual claims is astounding.

We all know about the 1996 case by now but Peyton Manning wasn’t the only person that she went after. The Associated Press released a report in 1997 outlining a whopping 33 claims made by Naughright (then known as Jamie Whited) against athletes, trainers, coaches and administrators between 1990 and 1996. It seems that almost anyone who came in contact with her in the 90’s, assaulted or harassed her in some way, shape, or form.

Whoa! Those Facebook posts were incredible. I have a friend who has serious mental issues after he stopped taking his medication and his Facebook posts looked exactly like that. Calling everyone out for no reason in a rambling, vulgar way.

Shaun King is probably going to be sorry he jumped on her bandwagon.

The 2nd U.S. Circuit Court of Appeals in Manhattan gave a players’ union lawyer a tough time, with Circuit Judge Denny Chin even saying evidence of ball tampering was “compelling, if not overwhelming,” and there was evidence to support a finding that Brady “knew about it, consented to it, encouraged it.”

The judges did not treat the NFL gingerly either, with Parker questioning whether Goodell took his authority too far by designating himself the arbitrator and making findings that went beyond a report prepared by an investigator the league hired.

The judges also questioned why deflating footballs would warrant a severe suspension.

But they seemed to answer that question themselves when Kessler stood before them as they noted repeatedly that it may well be within Goodell’s authority to punish a player if he concludes that the player interfered with an investigation and thus engaged in conduct detrimental to the game.

Neither Goodell nor Brady was in court Thursday. A decision could take weeks or months.

I'm relieved.

I was dreading having to see the Broncos cut him and then embarrass himself somewhere like Houston or Cleveland.

I have a feeling Osweiler will sign after the retirement announcement Monday. Curious if all this has been strategically managed. Osweiler takes the contract it's rumored he was offered, but not making it official until after Manning gets the spotlight one more time.

Why in the world would the nfl keep pushing on deflategate? Seriously. It is only hurting their brand at this point for it to be continuously brought up. I would let it slip quietly away if I were them.

Also glad to see manning retire. He's a great one, but it's time to go.

In addition to stessier's point, this isn't them "keep on pushing" it. This was the hearing that was scheduled back when the NFL filed their appeal immediately after the adverse ruling.

As stessier notes this has nothing to do with deflate gate. This is about the scope of Commissioner power under the CBA. Neither side can just give in because of the precedent it would set.

I think it will be better for the team in the middle term, too. It will clear some payroll for a guy who getting injured too much and has been getting long in the tooth even if he was still receiver A.

I also believe it will more expose Matt Stafford and as long as Matt doesn't get an extension now, that is a good thing, IMO. If he does get an extension now and Calvin is gone and we don't get more once in lifetime help, then the middle term, not so much...

Anyhoo, like last year, when the time comes I'll watch the first two games and those games will decide how I spend Sundays for the season.

Stafford did very well with Tate as number 1 season before last. Time for them both to step up again. Other than that I agree with it being a good thing.

This gives him a chance to sink or swim without Johnson. I would not give him a contract extension before the test. If they get an early draft OLine pick that is ready on day one and supplement the loss of Johnson with a free agent receiver and they still have such an anemic offense then ride Stafford's contract out while we're training Conner Cook :ninja:

Sadly I don't see Conner making it to the second round much less to the Lions in the second round.

Health is relative. Supposedly his hands are seriously messed up and he has pain getting up and walking around. Now money he should have.

Most people in Detroit understand the decision. I sure don't blame him. I will miss him though, he was phenomenal to watch play.

Looks like Denver lost 2 QBs in the last few days. Osweiler going to texas.

It also seems like Forte is headed to the Jets.

I don't think that's a big loss for the Bears. Langford proved very capable and may be better at this point in his career than Forte. Not so for the backups in Denver who have proven nothing.
